Terms of Use for Cville FoodLink

1. Overview
Cville FoodLink is a community platform operated by an individual. The app connects volunteers with people in need of food delivery or assistance. By using the Cville FoodLink mobile application (the “App”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, you must not use the App.
2. Description of Service
The App provides a digital platform for connecting community members seeking food assistance with volunteers who may be able to help. Cville FoodLink does not provide, control, supervise, or direct the delivery of food, and does not employ or insure volunteers or requesters. All activities, deliveries, and communications are performed directly between users.
3. Eligibility
Users must be at least 13 years old to create an account or use the App. Users under 18 must have parental consent.
4. Acceptance of Terms
By creating an account or using the App, you confirm that you have read and agree to these Terms and our Privacy Policy. You acknowledge that Cville FoodLink is a connecting platform only, and that you use the App at your own risk.
5. User Responsibilities
Provide accurate, truthful, and lawful information when creating requests or volunteering.
Use the App respectfully and safely, following community guidelines.
Do not use the App for illegal, fraudulent, or harmful purposes.
You are solely responsible for your conduct and interactions with other users.
6. No Vetting or Background Checks
Cville FoodLink does not perform background checks or verify user identities. Users are advised to use their own judgment when interacting with others and to exercise caution when meeting or exchanging items.
7. No Warranty (“As Is”)
The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind. Cville FoodLink disclaims all express and implied warranties, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee the reliability, safety, or accuracy of user content or actions.
8. Assumption of Risk
By using the App, you voluntarily assume all risks related to your interactions, deliveries, and communications with other users, including the risk of personal injury, property damage, or loss. Cville FoodLink is not responsible for any harm resulting from user interactions.
9. Limitation of Liability
To the maximum extent permitted by law, Cville FoodLink and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from or related to your use of the App. In no event shall total liability exceed $100 or the amount you have paid to use the App in the past 12 months, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cville FoodLink and its operator from any claims, damages, liabilities, and expenses (including legal fees) arising out of or related to your use of the App, your violation of these Terms, or your interactions with other users.
11. Safety and Emergencies
The App is not a substitute for emergency services. In case of danger or medical emergency, call your local emergency number (e.g., 911 in the U.S.). Cville FoodLink may suspend or remove users who violate these Terms or pose safety risks to others.
12. Data and Privacy
Your use of the App is governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described therein.
13. Reimbursements and Financial Transactions
Cville FoodLink does not process, handle, or facilitate any form of payment or reimbursement between users. Any reimbursement or exchange of funds is a private arrangement made directly between the requester and volunteer outside the App. Cville FoodLink makes no guarantees regarding reimbursement, payment, or any related disputes, and assumes no responsibility for such matters.
17. Safety and Caution Tips for Using the App
Cville FoodLink encourages all users to act with caution and common sense when using the App and when communicating or meeting with others.
The following safety guidelines are strongly recommended:
Use good judgment when making or delivering requests. Only proceed with deliveries or meetups that you feel comfortable with.
Only share your address or location details when necessary to complete a delivery or request, and only with trusted users.
Keep communication within the App whenever possible, and avoid sharing personal contact information until you trust the other party.
Let someone know your plans — such as a friend or family member — before making a delivery or pickup.
Trust your instincts. If something feels unsafe or suspicious, do not proceed and report the concern.

Cville FoodLink is not responsible for user conduct or any interactions that occur outside of the App. By using the App, you agree to take full responsibility for your own safety and to exercise reasonable judgment and care when interacting with others.
14. Governing Law
These Terms are governed by the laws of the United States and the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute shall be resolved in a court of competent jurisdiction located in Charlottesville, Virginia.
15. Changes to Terms
We may modify these Terms from time to time. Updated versions will be posted on our website or in the App and will take effect immediately upon posting.
